F45 Training - Islington T&C's Class Pass & Membership Agreement

 

For clarity:

All the headings and sub-headings are for convenience only and are not to be taken into account for the purposes of interpreting it.

Any reference to “the Company” is to mean “B & S- Fitness Ltd"; Company number 10348239, trading as “F45 Training - Islington”

Unless the context clearly requires otherwise, any reference to “F45 Training - Islington” or “B & S- Fitness Ltd” is to include the other

Usage of the terms “We” and “Us” are to refer to “the Company”

Usage of the terms “You” and “Your” is to refer to the client.

The Agreement:

​

1.Waiver Form 
You agree to sign a waiver form with F45 Training - Islington.

2. Minimum age
 You understand and agree that the minimum age for training with Us is 16. Clients under the age of 18 are required to provide a certificate from a parent or legal guardian confirming understanding and acceptance of the risks posed to You during Your time training with Us.

3. Use of Your image
 You understand that during the course of Your time training with Us, photographs and/or video’s may be taken in which You may be identifiable. You understand and agree to allow Us and our agents and affiliates to take photo and video of You for promotion purposes from time to time.

4. CCTV Closed circuit cameras operate throughout the studio (except in the changing areas), any unlawful activity within the studio may be reviewed for possible legal action.

5. Cooling off period
 You can cancel Your CP/Membership with Us up to 7 days from the date of purchasing Your CP/Membership. This cooling off period is only applicable to new clients. If You have previously trained with Us on an introductory offer, or any other class pass and/or Membership, the cooling off period does not apply. If You cancel within the 7 day cooling off period, We will refund Your money less any set-up fee or the value of any promotional items We may or may not have included in Your CP/Membership.

6. Paying for Memberships and Your account
 Membership fees are paid in advance, by direct debit from a bank account or credit card. You understand and agree to provide Us with permission to securely store Your card details on file and You authorise Us to charge Your card for any Membership fees or account payments You make with Us.

7. Your Health.

You warrant that You are in good physical condition and You know of no medical (or other) reason why You cannot or should not do active or passive exercise.

You warrant that You are aware that all exercise carries risks, and acknowledge You are participating willingly, and in knowledge of these risks.

You recognise that We are not able to provide You with medical advice, and that any information provided should be used as a guideline only. If You have any prior knowledge of health concerns or health risks, You acknowledge that it is Your responsibility to seek clearance from a health care professional.

You shall not use any studio facilities whilst suffering from any infectious or contagious illness, disease or other ailment or whilst suffering from a physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other Members.

8. Indemnity. 
You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for F45 Training - Islington.

9. Meeting Your Responsibilities and Paying for Your Account

You acknowledge and agree:

To make sure Your bank account can accept direct debits and to ensure that there is enough money in Your account on the payment day for Us to collect the full amount owing To tell Us if You are transferring or closing Your account at least 1 week before the next direct debit

That it is Your responsibility to tell Us about any changes to Your credit card on file, such as its expiry date or number, at least 1 week before Your next debit is due.

To make sure that the payment method You choose remains valid for the full length of your Membership term.

If Your chosen payment method fails, You are liable for any and all resulting fees.

If You do not fully pay Your fees on the due date, F45 Training - Islington may suspend access to the services and facilities until any outstanding balance has been paid and You have given Us Your updated account details (if they are required). You understand and acknowledge that We will continue to debit Your nominated account without notice, until We have received the total amount You owe Us.
 We will make a reasonable effort to advise You on the status of the failed payments by auto-email.

If such amounts are not paid in full within 60 days membership shall be terminated and We may pursue any rights it may have to recover the unpaid amount. We reserve the right to refer any missed payments to a debt collection agency and will charge You a fee, in respect of failed subscription payments and/or collection letters sent to You in respect of unpaid amounts.

10. Can We Change Your Agreement?
 We may sometimes add to, change or remove some terms and conditions. This includes (but is not limited to) changes to the opening and closing hours, the services and facilities available at the studio and Membership fees. The most up-to-date terms and conditions and Membership Agreement will always apply. We will try to provide as much notice as possible where these changes will impact You. Unless the law states otherwise, You waive any claim against Us with regards to these changes.

11. Can We increase Your fees?
 We reserve the right to increase Your fees only at any time after the term of Your initial agreement has passed. We will make a reasonable effort to let You know beforehand by writing to the address You last gave Us (which may be an email address). We will consider that You have received our letter or email on the first business day after it is sent.
Where We have made a reasonable effort to let You know about a fee increase, You authorise Us to charge Your account for the increased fees.

12. Suspensions 
You acknowledge and agree:

You cannot provide notice of intent to Terminate/Cancel whilst Your account is suspended.Memberships can be suspended at any time provided You give Us at least 2 weeks written notice of the suspension. The minimum suspension period for each suspension of Your account is 2 calendar weeks.

You can suspend Your Membership for a maximum period of 8 calendar weeks per year. For the purposes of clarity, this will be a year period from the date of commencement of your current Membership at F45 Training - Islington.

A one-off admin fee of £20 applies for each suspension of Your account

Suspensions cannot be backdated.

Requests for suspensions must be made on the suspension form available at www.f45islington.com or can be emailed to you. You will receive an email confirmation within 2 working days.

13. Cancellations/Terminations. 
You acknowledge and agree:

For Memberships without a minimum commitment period, there is no fee to cancel/terminate your Membership.

Cancellations can only be processed in-line with Your regular billing schedule.

A minimum notice period applies of 1 month when cancelling any Membership.

Notification of intent to cancel must be provided in writing. For example if your next payment date is the 2nd May and We receive your cancellation form on or before the 2nd May only May will be due, however if received on the 3rd May both May and June will be due. 

Requests for cancellation must be made on the cancellation form available at www.f45islington.com or can be emailed to you. You will receive an email confirmation within 5 working days. Membership cannot be amended whilst in the notice period. Verbal instructions to amend or cancel a membership cannot be accepted, all requests must be in writing. Memberships can only be cancelled if subscription collection is active. Monthly fees and/or prepaid fees are not refundable.

 

For Memberships with a minimum contractual term there is a cancellation fee equal to 50% of the remaining contract value, with the only exception to this where there has been a sickness or injury resulting in the inability to train for the remainder of the contract term, where You must provide Doctors certificate to this effect.

14. Late fees/No shows. You agree to adhere to the cancellation terms of 9pm the night before for morning classes and 2 hrs before at any other time. A cancellation after this point will result in a charge of £10.00.

If you do not cancel and are a 'no show' you will be charged up to the full price of a class £15.00
